The
Internet Merchandising Systems Inc. license agreement
SINGLE USER LICENSE
This is a legal agreement between you,
the user (as an individual or an
organization) and Internet Merchandising
Systems Inc. (IMS) &
(IMS Transit™, IMS Voyager™, IMScart™).
1. Single user license
This IMS license agreement gives you
the right to use only one copy of
the purchased IMS product on one
standalone computer system. Using more
than one copy at the same time is NOT permitted.
Each purchased copy of
software is installed including its unique serial
number.
2. Upgrades
If the product is an upgrade from a
previous version you may use the upgraded
product only in accordance with this
Single User license Agreement.
3. Copyright
All title and copyrights in and to the
changed and enhanced product features and
additions (including but not limited to any
images, photographs, animations, video,
audio music and text, incorporated into
the product, the accompanying printed
materials, and any copies of the product,
are owned by Internet Merchandising
Systems Inc.
(IMS).
"This product also includes some software developed
by Edikon Corporation for use in phpShop.
(http://www.phpShop.org/)."
The product is protected by copyright
laws and international treaty provisions.
You may not copy the product, the programs
or the printed materials, by any means
without the explicit written permission of
the authors or copyright owners.
4. Other limitations
You do not have the right to sell, lend, lease
or rent out any IMS software product.
This right is only obtained with a special
license agreement.
5. Limited warranty
Internet Merchandising Systems Inc. and/or its suppliers
only guarantee that the IMS software
product will perform substantially in
accordance with the mentioned requirements
for a period of 90 days from the date of
receipt.
6. Customer remedies
The copyright owner, Internet
Merchandising Systems Inc.
and its suppliers' entire liability and
your exclusive remedy shall be, at
Internet Merchandising Systems Inc. Limited Money Back
Guarantee.
7. No liability for consequential
damages
To the maximum extent permitted by
applicable law, in no event shall the
copyright owner, Internet Merchandising
Systems Inc. or its suppliers be liable
for any damages whatsoever (including
without limitation, direct or indirect
damages for personal injury, loss of
business profits, business interruption,
loss of business information, or any
other pecuniary loss) arising out of the
use or inability to use this product,
even if the copyright owner, Internet
Merchandising Systems Inc. and its
suppliers have been advised of the
possibility of such damages. In any
case, the copyright owner, Internet
Merchandising Systems Inc. and its suppliers'
entire liability under any provision of
this agreement shall be limited to the
amount actually paid by you for the
product. Because some states/jurisdictions
do not allow the exclusion or limitation
of liability for consequential or
incidental damages, the above limitation
may not apply to you.
8. No other warranties
To the maximum extent permitted by
applicable law, the copyright owner
(Internet Merchandising Systems Inc. and its suppliers
disclaim all other warranties, either
express or implied, including, but not
limited to implied warranties of
merchantability and fitness for a
particular accompanying hardware or
software. This limited warranty gives you
specific legal rights. You may have others
which vary from state/jurisdiction to
state/jurisdiction.
Special provisions
Reverse
engineering
Wherever you acquired the product, you may
not reverse engineer, decompile, or
disassemble the product for resale. You
may make change to the source code for
your own use according to the above
license agreement.

proprietary and uses open
source architecture to allow licensed third party developers to
design compatible applications.
In particular: we use PHP a widely-used scripting language especially suited for Web development.
